A former human resources manager has filed a lawsuit against Tyson foods claiming that company committed age and gender discrimination.
Rita Huske filed suit against Tyson Foods Inc. on Sept. 11 in the Eastern District of Texas, Sherman Division.
Huske was employed by Tyson Foods at its Sherman Case Ready Plant as the complex human resources manager since October 2005. Prior to the position as a manager, Huske was employed by the defendant for more than 29 years in various positions. She was terminated on Sept. 30, 2011.
Prior to her termination, she was told that she was “not the right fit” for the facility and she did not play the “gray area” enough.
According to the lawsuit, she was replaced by a male, aged approximately 30 years old, whom she had trained.
The defendant is accused of age discrimination in violation of the Employment Act and gender discrimination in violation of Huske’s civil rights.
The plaintiff is seeking an award of damages, liquidated damages, mental anguish, punitive damages, attorney’s fees, court costs and interest.
Huske is represented by Ronald R. Huff in Sherman. A jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
